Q. Would you put the Diversion on the application? There was no conviction of DUII, but the Diversion is never expunged from the record. Is this an immediate turn-off for an employer?

I got a written arrest (mist.) for underage drinking. i took the offer for pre-trial diversion. i was sent to the review board for failure to meet my requirments. they extended my pretrail in order for me to complete addition treatment that was recomended. i missed some apts. due to my father having two heartattacks. what happens if i am terminated from pre-trial diversion or i choose to leave pre-trial? what will happen if i get sent back to court for the charges... is there jail time?

A. Since you live in Florida I would suggest getting a paid attorney.. Depending on the charge that you have it will depend on how much you will have to pay. I would interview a bunch of attorneys. They will advise you for free then they will want a retainment fee. For taking your case. But you can talk to lots of them for free. Do that then pick the best one. Sometimes paying a little more is better . Your paid attorney will tell you if this case can be expunged or not. I know that you can't expunge something till a year later. But I would get an attorney. If you go to court without a lawyer be prepared for the cops to lie and try to press more charges against you. The legal system in the state of FL is crooked. Get a lawyer

A. This is the only info i could find on it, if you were charged before 18 then you could still participate, Though the diversion program began in 1983, refinements are still being made. A recent development has included the scheduling of mandatory 90 minute classes for at least one parent for any participant under the age of 18. This gives CNCA an opportunity to encourage adults to take underage drinking more seriously.~

A. "Probably" is the key word here. We don't know what the court would do. I think the court would take offense at your presumption of their order. You can call the prosecutor's office (district attorney) and ask them to review your case and allow you to do this ahead of time. They are always looking for ways to clear cases quickly and if you are offering to cooperate in this manner they should jump at the chance.

Can a get a person get a job at a bank if they have entered a pre-trial diversion program for retail theft?
Q. There was never a conviction and the charges were later dismissed. Also the whole arrest was expunged and sealed. The job application asks if a person has ever been convicted, so for that its legal to say no. But, there is also a question about whether or not the person has ever entered into a pre-trial diversion program for retail theft. Can this be answered "No" since the whole issue was expunged??? Or, if answered "Yes" would a person be automatically disqualified for employment?

A. Banks do do a background check for employment, as do many companies these days. I would NOT answer the questions falsely as this would be a reason for not hiring you. If you answer the question truthfully, you can always elaborate about the question in your interview.

Q. My friend got caught with less than 40g of marijuana on him and was wondering how long would his diversion most likely last? And he does not need treatment. A. LOL dude he's lucky to get a diversion. I got caught with only a bowl with resin on it and they almost didn't give me a diversion. A diversion usually has you meet with a substance abuse program and they assign things for you to do in order for the incident not to go on your record. Having 40g will probably get him 100 hours of community service and a have to enroll in some sort of anti-drug program

Job offer with failed background check from pretrial diversion omission?
Q. I was offered a job subject to a background check for a financial service/bank. Unfortunately I was deemed unbondable. In 2002 I went on pretrial diversion for a misdameanor. When filling out the application I answered that I was never charged with a crime and that was why I cannot get the job.
