How long after an expungement in Ohio before background check is clean?
Q. I am going for an expungement hearing in about one week. If I am granted the expungement, how long before a criminal background check does not see my conviction? Also, is there a list out there of all the government agencies that hold conviction information? I am in dire need of this to get off my record quickly! The expungement hearing is in Mahoning County. Any and all information and personal experiences are welcome!

A. Once a record is expunged (not dismissed, not nolle prossed, not not prosecuted - EXPUNGED) the record is not longer legally reportable by anyone. You will need to ensure that all records from the court are properly taken care of, and also contact the agency that arrested you, the department of corrections if you served any time and your state police agency to make sure that all applicable agencies also expunge your history from their records. In some cases, your records will remain on file with those agencies but will not be available to the public. Just cover all your bases, talk to the courthouse and ask for advice and you should be ok. Do not be surprised if the record shows up on background checks in the future, just be prepared… [cont.]

Does an expungement in California clear arrest records if a case was dismissed?
Q. Was arrested a few years ago on 2 charges but the case was dismissed due to a time lapse on the D.A.'s part in filing the charges. Now I'm looking into getting an expungement to clear up my record, even though I don;t have any convictions on it and I want to know if an expungement will clear up my arrest record as well, or if it is just meant to clear up a record of convictions?

A. You cannot get an "expungement" under Pen C 1203.4, because all that really does is dismiss a conviction, and you don't have a conviction. You can get a finding of factual innocence under Pen C 861.8 only if there was no reasonable cause to believe you committed an offense. A dismissal of a complaint due to a time limitation will NOT be a sufficient basis for a finding of factual innocence.

Q. On Sept. 29 I payed the $50 fee at the court house and did my expungement paper work. My question is how long do you think it will take until my record is cleared? A. The numbers will vary depending on the attorney. Usually they don't charge per hour they charge a flat rate. The Mississippi State Bar Association can give you a referal for a good criminal attorney in the area.

A. That is the CA statute, I'm guessing? Yes, you can file for expungement of your juvenile record under 1203.4a. While juvenile records are sometimes sealed in CA, it is not automatic and it does not apply if the juvenile was charged as an adult. Also, expunging the conviction does not seal the record unless you also petition to have that done. Instead, the record will show a change of plea to "not guilty" and a dismissal of the charges.

A. Unless your case is complicated for some reason, you should not need to pay a lawyer. You need to know, however, that an "expungement" is not a means of destroying records completely. A. You must comply with and complete all of the provisions of your sentence, including paying all court ordered restitution, before expungement can take place. You cannot get a conviction expunged if you haven't.

A. According to AR 601-210, Chapter 4-7f(2), you can get in with an expunged domestic violence charge unless your right to possess a firearm wasn't returned to you. The main thing you need to consider is whether or not you will be allowed to hold a firearm after your expungement. You still have to reveal the charge to the Army and the disposition. Now, this is the tricky part. The Army is restricting the levels of waivers you can get. Can you get in with your charge? Maybe, maybe not. If it is a felony charge then you can't come in, period. I never personally processed anybody with a misdemeanor domestic violence charge even if it didn't fall under the Launtenberg Amendment and I doubt I will anytime soon. A. This is a difficult question to answer, even with knowledge of Penal Code section 1203.4 (which none of the answerers before this appears to have). Expungement under that statute in California does not actually remove the conviction from your record, but the record should show that the conviction was dismissed. There is some case law which says that you can then tell potential non-government employees that you were not convicted of the offense. However, the California Judicial Council says that you must say that you were convicted, and the conviction was dismissed. And, bottom line, whatever you say it is likely that a potential employer will be able to see the record, because the records go into all kinds of data bases. My advice has… [cont.]
