How long after an expungement in Ohio before background check is clean?
Q. I am going for an expungement hearing in about one week. If I am granted the expungement, how long before a criminal background check does not see my conviction? Also, is there a list out there of all the government agencies that hold conviction information? I am in dire need of this to get off my record quickly! The expungement hearing is in Mahoning County. Any and all information and personal experiences are welcome!

A. Once a record is expunged (not dismissed, not nolle prossed, not not prosecuted - EXPUNGED) the record is not longer legally reportable by anyone. You will need to ensure that all records from the court are properly taken care of, and also contact the agency that arrested you, the department of corrections if you served any time and your state police agency to make sure that all applicable agencies also expunge your history from their records. In some cases, your records will remain on file with those agencies but will not be available to the public. Just cover all your bases, talk to the courthouse and ask for advice and you should be ok. Do not be surprised if the record shows up on background checks in the future, just be prepared… [cont.]

If someone had their case dismissed and is getting an expungement, should they wait to apply for jobs?
Q. The dismissal was fairly recent, within the past 6 months. The expungement will take at least until March. Would it be a better idea to just wait for the expungement then begin applying after the expungement? Thanks!

A. I do not know where you live but in most states there is a fee for expunging something from your record not counting court cost, and filing all the paper work. You do know even if you do get it expunged from your record it will always be there it just can not be used against you. Good Luck

Are you just "bragging up" your involvement in your supervisor's work, or are you confessing to multiple crimes? As for the question, Anita is right. You have the right to represent yourself. A. For your California conviction, go here: I am not a federal expert, but I don't think there is equivalent relief unless you were prosecuted under the juvenile offenders act. You have to obtain a (very rare) Presidential pardon.

Q. but I am stuck on who to send them to. I need to file at the 3rd district (Rolling Meadows) so I have addressed to the states attorney at the rolling meadows courthouse. A. If you had no violations of law after conviction, and "lived an honest and upright life," then you are entitled to PC 1203.4a relief as a matter of right. Unless the prosecutor comes up with some kind of misconduct, the court is going to grant relief. However, contrary to what appears to be the law elsewhere, a California "expungement" does not do you a lot of good. The conviction will show on your record, even after PC 1203.4a relief is granted, and employers have means of finding it. My advice is not to say that you have not been convicted, but to answer the question by saying that a misdemeanor charge was dismissed under PC 1203.4a, which is completely correct. A. My advice to ex-offenders who land a job in the process you are describing, is to go to the employer after you have worked there for awhile, and explain the circumstances. Explain that you were honest, but you really like your job and want to make a career out of it...and, out of respect for her/him, you want to offer some detail to more fully explain the answer you offered. Same thing if it comes up in the interview. (Although I don't know why it would if you answered no on the app.)

A. Better start by reading the statutes. It is possible that there is no expungement for violations of the muni code. I am not inclined to look it up for you and if you are not willing to hire someone to do the research, then learn to do it yourself.

A. This is a difficult question to answer, even with knowledge of Penal Code section 1203.4 (which none of the answerers before this appears to have). Expungement under that statute in California does not actually remove the conviction from your record, but the record should show that the conviction was dismissed. There is some case law which says that you can then tell potential non-government employees that you were not convicted of the offense. However, the California Judicial Council says that you must say that you were convicted, and the conviction was dismissed. And, bottom line, whatever you say it is likely that a potential employer will be able to see the record, because the records go into all kinds of data bases. My advice has… [cont.]

A. In non-adjudication the defendant generally enters a guilty plea but the Judge will withhold acceptance of the plea and imposition of the sentence pending successful completion of certain terms such as probation. Defendants are not convicted but are on probation and must follow probation rules as violation would result in a revocation of the non-adjudication status. A defendant who successfully completes the terms will have the matter resolved without ever receiving a conviction. In expungement, a defendant has already been convicted of the crime. Once a certain period has passed, the defendant petitions the court to have the conviction removed (expunged) from his record.
