Intellectual property (IP) is a number of distinct types of legal monopolies over creations of the mind, both artistic and commercial, and the corresponding fields of law. Under intellectual property law, owners are granted certain exclusive rights to a variety of intangible assets, such as musical, literary, and artistic works; ideas, discoveries and inventions; and words, phrases, symbols, and designs. Common types of intellectual property include copyrights, trademarks, patents, industrial design rights and trade secrets in some jurisdictions.

Although many of the legal principles governing intellectual property have evolved over centuries, it was not until the 19th century that the term intellectual property began to be used, and, it is said, not until the late 20th century that it became commonplace in the United States.

Pro/cons of illegally downloading intellectual property?
Q. I have to write a short essay about the pros/cons of downloading intellectual property ie: music, games, software. The cons are easy; however, I am having trouble coming up with substantial pros to the situation. I do not download music or anything so I am not familiar with this process. Thank you for any help!

A. Pros: It's free to you It's easier to grab a discography torrent than buy fifteen CDs No lost inventory, only a potential lost sale Some things aren't on Compact Disc/DVD or iTunes Some records have to be imported, or are very hard to get The RIAA/MPAA deserves it, as do anyone who signs with them The price of digital media outweighs utility of the content Pirates still see concerts, buy shirts, and give word-of-mouth EVERY control scheme will fail (Google Rockstar and GTA IV piracy!) General moral relativism developing countries can't afford authentic media (Google it... Russia and Latin America mostly use pirated media) Cons: Record companies lose potential sales Record companies get stuck with dead CD inventory Record companies have… [cont.]

  • "I believe in intellectual property. In my view, it's the foundation of world economies, and certainly the foundation upon which Sun Microsystems was built. Copyright, trademark, patent - I believe in them all. I also believe in innovation and competition - and that these beliefs are not mutually exclusive." — Jonathan I. Schwartz

  • "And having said it before, let me say it again. I believe in IP. I believe in its value, both economic and social. I believe it should be protected, as any other property, as a means of fostering independence, investment and autonomy. And not just in wealthy nations - but in those struggling to build wealth or pay down debt. I believe the creation, protection and evolution of intellectual property can accelerate everyone's ability to participate in an open network...And that, surely, should be everyone's common goal with free and open source software. It's not about bringing the competition down, it's about driving global participation up." — Jonathan I. Schwartz
