A. you need to call your state police department and see how long something needs to be on your record in order to get it expunged. once you know that, then you can go through your states expungement process, which will differ from state to state.

How does an expunged misdemeanor affect getting your real estate license?
Q. I was thinking about going into real estate, however I know you can't be convicted of a misdemeanor and I had one 3 years ago but it was expunged.

A. Hello Stephanie. The definition of expungment means to erase as though it never happened. If you have your misdemeanor expunged, you can legally state you were never convicted. Expunged records still technically exist, but can only be accessed by law enforcement and the court system under certain circumstances. No employer background check will show anything. Best of luck and I hope this is useful to you

Does an expunged misdemeanor disqualify you from getting a California state license in phlebotomy?
Q. In 2006, I was convicted of a misdemeanor theft (PC 487-A). I have since then fulfilled the conditions of probation for the entire period. On June 11, 2009, I petitioned for a dismissal / expunge of such convictions, which was granted to me by the superior court of los angeles (Case #: 6BF02115) pursuant to Penal Code Section 1203.4 on June 25, 2009.

I know you can pay a lawyer or do it myself but does it really work. Im gonna be going to school surgical tech, and if i have a misdemeanor they wont let me take the state board exam, just wondering if anyone has done it and if it really works before i go thru the process and money.

A. Well, you aren't going to be able to get it expunged. Nor, with all due respect to the officer who answered above, can you just ask the trial court nicely if they could please get rid of your record. What you may be eligible for is a separate remedy called a non-disclosure order. There are some specific eligibility requirements you'll have to meet, and a motion for non-disclosure and the corresponding order will need to be prepared correctly. I would highly recommend that you contact a good local defense attorney, and make sure they've actually handled these before. They're not that difficult, but they are kind of unusual, and most defense attorneys have never done one and may not have even heard of them. Non-disclosures are NOT the same… [cont.]

Will an expunged misdemeanor effect employment opportunities in future?
Q. I am currently on probation for a misdemeanor marijuana possession charge in NJ. Upon completion of my probation for my conditional discharge I will have this charge expunged from my records. Will future employers see this if I complete my probation? Will this effect future employment opportunities? PS. This is my first and only charge with no priors. It was considered a petty offense since I was only caught in the act of smoking it, but it is still a misdemeanor
Asked by dahazy2k - Wed Feb 25 01:45:12 2009 - - 1 Answers - 0 Comments
A. You are extremely lucky to have a deferred discharge allowed. Complete everything and the court will automatically expunge your record. This means it will not be visible to any employment check but is placed in a secured area that is accessible to law enforcement and the court system only. Note that if any actions occur after this is completed, you cannot by law be offered this again. It only works on a first offense. Best of luck and I hope this is useful to you

How do you get an out of state misdemeanor expunged from your record without an attorney?
Q. I wrote a nasty letter to an abusive exboyfriend and he filed harrassment charges against me and won because I didn't fly out there and defend myself in person and my lawyer had a bigger case that day and didn't send a replacement. I paid the fine, it was cheaper than the flight across the country and the lawyer was a friend and didn't get paid or charge me anything. I just can't get a job with the government or some other places with a criminal record. Plus I was innocent.

Can I have a misdemeanor expunged from my record?
Q. Back in my college years (2002) I was arrested for public intoxication after a heavy night of drinking at the bars. I spent the night in jail and paid a $300 fine and thought nothing else of it. When I recently started my career, I almost lost the job due to a background check which found the incident (I didn't report it to them on my application, luckily after some explaining they were OK with it). I am very worried about this haunting me all my life any time I want to change jobs. Is there any way to get my record sealed/expunged so that a background check won't reveal it? Uncle John, like I said this was four years ago. Besides the night in jail and the fine, nothing else came of it. No court date, no probation, no community service,… [cont.]

A. You can get it expunged if you have no other convictions. Contact the prosecuting attorneys office in the county you were arrested in and they will send you the papers. It takes a while to do but is worth it.

Will an expunged juvenile misdemeanor show up on an employment background check?
Q. When filling out a questionnaire for an employment background check, do I still have to check "yes" for having been charged with a juvenile misdemeanor even though it is expunged???
Asked by Lola M - Wed Jul 9 09:25:56 2008 - - 2 Answers - 0 Comments
A. Dear Lola: No. If a record was expunged, it means that you where never "convicted" of the crime. Please understand, however, that if you apply to any police or federal agency, they will have access to this record. All other companies and agencies do not have access to any expunged or sealed records. Therefore, you need to mark "no" for regular applications, unless you are applying for a position in law enforcement, except security guard.

Why is an expunged misdemeanor appearing on a background search? I thought expunged meant eliminated/sealed?
Q. In california. Is there anyway to have an offense for which there wasn't a conviction or an expunged conviction removed from a background search?
Asked by teri - Sun Jun 21 17:17:32 2009 - - 3 Answers - 0 Comments
A. Expunged in California does not mean eliminated or sealed. It means dismissed, and you can tell private employers you were not convicted. Private employers are prohibited from asking about or considering convictions dismissed under Pen C 1203.4. To get the matter sealed you would have to get a judicial finding of factual innocence under Pen C 851.8, and that is not available if you were convicted.

A. If the conviction of a drug related offense stays on your record, you can forget any career dealing with medicine or respiratory therapist. Since this is your future career, best advice would be to consult with an attorney and see what can be done to remove this from all public view. It will cost you, but it is your future at stake, so I definetely think it would be worthwhile to do. Best of luck and I hope this is useful to you

A. Michigan calls expungement "Setting aside a conviction" and it removes a criminal conviction from the public record. If this occured in Michigan then the self help web site tells you if, how and forms. If the charge was in a different State then you'll need to see that State law.
