How does an expunged misdemeanor affect getting your real estate license?
Q. I was thinking about going into real estate, however I know you can't be convicted of a misdemeanor and I had one 3 years ago but it was expunged.

A. Hello Stephanie. The definition of expungment means to erase as though it never happened. If you have your misdemeanor expunged, you can legally state you were never convicted. Expunged records still technically exist, but can only be accessed by law enforcement and the court system under certain circumstances. No employer background check will show anything. Best of luck and I hope this is useful to you

Will an expunged misdemeanor theft conviction bar me from getting a job at Goldman Sachs?
Q. I have an old conviction for misdemeanor theft from five years ago that was expunged. I'm currently in the States and last week I was given an offer from Goldman Sachs to work in their Japan division. I'm really happy but really freaked out because I'm worried that my old conviction might come back and bite me in the butt. If anyone knows if this will haunt me, please let me know! Thanks in advance!

A. If it was expunged I don't know that it'll turn up if the company does a background check. My old company checked employees SLED records to see if they had a record. I believe you can check your record, usually it's $25 in most states. You can also check all the states to see what shows up. If it doesn't show up on your records check it won't show up on theirs. If it does show on your record and you are asked then be honest because you can be terminated down the line for not disclosing the information. Also, most companies have a policy on how far back a conviction must be, the company I recently worked for had a 5 year span, anything prior to the last 5 years could not be considered in our hiring practice. Good luck to you.

How can I get my misdemeanor expunged in the state of Texas?
Q. Class a misdemeanor - possession of marijuana Happened in 2006, got differed judafication went through with everything, got my hours done and supervision. I know you can pay a lawyer or do it myself but does it really work. Im gonna be going to school surgical tech, and if i have a misdemeanor they wont let me take the state board exam, just wondering if anyone has done it and if it really works before i go thru the process and money.

A. Well, you aren't going to be able to get it expunged. Nor, with all due respect to the officer who answered above, can you just ask the trial court nicely if they could please get rid of your record. What you may be eligible for is a separate remedy called a non-disclosure order. There are some specific eligibility requirements you'll have to meet, and a motion for non-disclosure and the corresponding order will need to be prepared correctly. I would highly recommend that you contact a good local defense attorney, and make sure they've actually handled these before. They're not that difficult, but they are kind of unusual, and most defense attorneys have never done one and may not have even heard of them. Non-disclosures are NOT the same… [cont.]

Does a Misdemeanor get expunged from your record after a certain period of time?
Q. I wrote a check to a Wal Mart back in late 2001 that bounced. Because I was laid off from my job in the airline industry right after, I was unable to pay the check until Wal Mart had a warrant put out for me. I found this out when I went to the store to pay it back in early '02. I paid the fees, and restitution to the courts and plead guilty to simple worthless check. My question is, does a misdemeanor such as this get expunged from my record after a certain period of time, or do I have to ask to have it expunged. This has affected my ability as of late to apply for a few jobs that had nothing to do with handling any kind of money. Serious answers only please. Thanks.
Asked by aviationboatswainsmate - Mon Mar 26 20:36:19 2007 - - 1 Answers - 0 Comments
A. The answer depends on the state you live in. Some states will automatically expunge misdemeanors, but typically this only applies to juveniles. For adults you typically have to ask and there is no guarantee that they will in fact expunge your record. As an additional note, many crimes can be put on your credit report, you may want to check with the big three credit agencies (Experian, Equifax and Transunion) to ensure your misdemeanor isn't being seen by more people than you're aware of.

Is a misdemeanor expunged IMMEDIATELY after the government/prosecutor agrees to allow the motion to seal?
Q. I'm waiting for the response from the government on a misdemeanor that was dismissed. No records or crime after that. Will the expungment be finalized right after the government agrees or do I have to wait??
Asked by Jay - Wed Aug 12 19:43:53 2009 - - 2 Answers - 0 Comments
A. I'm a little confused, a motion to seal is different from a dismissal. If the matter will be sealed, it still remains on the court record, it is simply restricted from view except by another court order to open the records. The matter is still there. If a case is dismissed, while it may take a little while for the paperwork to go through, the dismissal is effective immediately and has the same net effect as if you had not been charged.

Is a misdemeanor case automatically expunged by the prosecutor or do I have to so it?
Q. I had a misdemeanor that was eligible for First time offenders program. When applying for employment is this still considered a conviction even though it was expunged? I'm applying for a job as a police officer, How do I make sure it was expunged?
Asked by Brian_S - Sun Jun 15 23:46:02 2008 - - 4 Answers - 0 Comments
A. If the expungement was written into the plea deal you had better follow up on it. If it was not written into the plea deal then you have to apply for expungement. If expunged it is as if you never had it but be aware that full disclosure is the best policy as a background check may pull it up anyway. Many police departments will overlook misdemeanor convictions unless they are sex related because that is a hot button issue. I would suggest you pull your own record to see what is on it and if the charge has not been expunged then apply. When applying be truthful and explain the circumstances along with why you are not the person that you were when the conviction happened. Also, check the laws of your state as each state approaches… [cont.]

Will an expunged juvenile misdemeanor show up on an employment background check?
Q. When filling out a questionnaire for an employment background check, do I still have to check "yes" for having been charged with a juvenile misdemeanor even though it is expunged???
Asked by Lola M - Wed Jul 9 09:25:56 2008 - - 2 Answers - 0 Comments
A. Dear Lola: No. If a record was expunged, it means that you where never "convicted" of the crime. Please understand, however, that if you apply to any police or federal agency, they will have access to this record. All other companies and agencies do not have access to any expunged or sealed records. Therefore, you need to mark "no" for regular applications, unless you are applying for a position in law enforcement, except security guard.

Why is an expunged misdemeanor appearing on a background search? I thought expunged meant eliminated/sealed?
Q. In california. Is there anyway to have an offense for which there wasn't a conviction or an expunged conviction removed from a background search?
Asked by teri - Sun Jun 21 17:17:32 2009 - - 3 Answers - 0 Comments
A. Expunged in California does not mean eliminated or sealed. It means dismissed, and you can tell private employers you were not convicted. Private employers are prohibited from asking about or considering convictions dismissed under Pen C 1203.4. To get the matter sealed you would have to get a judicial finding of factual innocence under Pen C 851.8, and that is not available if you were convicted.

Q. What about if the job applications asks if you ever expunged a criminal case, can you still answer no? It would be a help if you have Illinois information on it
Asked by Ddp - Sat Dec 15 18:49:33 2007 - - 3 Answers - 0 Comments
A. Expunged is as if it never happened and should no longer be on the criminal record. The problem is that it is never done right. So, first the application will not ask if you have ever expunged a criminal case. It will ask if you were ever convicted. As with a pardon, your record SHOULD reflect as if you have not done the crime, so you can answer no...LEGALLY. If they DO find out, then you can tell them that it was expunged, so therefore you have no conviction on your record. A typical criminal background check should not turn up an expunged record.

A. The charge is never 'completely erased.' All this means is that it is blocked from certian agencies. And 'expunged' record is completely visible to any Federal agency.
