Will I be drug screened after completing pretrial diversion?
Q. I just finished up my six months of pretrial diversion in Louisiana. After the paper work is finalized a paper will be sent to the judge to sign a paper to ex sponge my charge (Possession of paraphernalia). My question is will I be drug screened again before he signs the paper? If you have actually been on pretrial diversion I would appreciate a response.

Job offer with failed background check from pretrial diversion omission?
Q. I was offered a job subject to a background check for a financial service/bank. Unfortunately I was deemed unbondable. In 2002 I went on pretrial diversion for a misdameanor. When filling out the application I answered that I was never charged with a crime and that was why I cannot get the job. Its been 7 years since than and after one year of probation, the charges are dropped and expunged from my record in Indiana. How did the background check come up with this and what can I do?

A. Though I am not a Tenn. attorney, this is probably accurate in all jurisdictions. Generally, a condition of release lasts only until the case is resolved in some way, which would include a diversion program. However, it is very common that some of the conditions of release will also be conditions of diversion (or of probation if probation is granted). Whether the defendant will be able to contact the victim will depend upon those conditions. Often in a domestic violence situation the defendant is prohibited from contact, despite a marriage.

A. You're trying to mix apples and oranges. One is asking were you ever convicted of a misdemeanor. You're trying to put your punishment wasn't substantial enough for the crime. They are only interested in the crime and conviction, not the punishment. Most companies are looking for "was this person convicted of embezzlement". If not they really don't care. Now if you lie then you make the matter worse.

A. It depends on the rules governing the diversionary program, as well as any court rules and the terms of the plea agreement. You should have a lawyer, who could explain whether the plea can be withdrawn if you are rejected from the diversionary program.

What is the length of a Federal pretrial diversion program?
Q. I was told by a federal agent that it is 3 years, but I'm reading it's a maximum of 18 months. Who's right and who's wrong? I was told it's some supersecret probation deal that lasts 3 years...but that seems a tad excessive. I would assume 18 months is more reasonable. In case you're wondering, this has to do with something I said on the internet about certain members of the administration that I said in jest. Apparently, the Feds, or the DA think this is serious enough to do all of this, but I think it's an infringement upon my 1st amendment rights. I shouldn't even have to do this in the first place.

A. Most pretrial diversion programs run from 18 to 24 months, depending on the nature of the crime and perceived rehabilitative needs of the "defendant." Also, if there is any economic loss to the victim, the amount of any restitution is taken into account when determining length of the program to allow for the monies to be paid by the time the program date expires. I suppose in a particular case, a pre-trial diversion officer can recommend to his/her Chief Pre-Trial Diversion officer a period of three years. Q. Well I was originally on pretrial diversion for underage consumption in the state of Tennessee. I finished 3 of my 6 months probation and I was then arrested in Northern Kentucky for providing a false name and birthdate due to fear of being trouble for drinking at my friend's party and violating my diversion in Tennessee. I was stupid and should've learned the first time not to drink anymore. I was wondering since I am now on pretrial diversion in Northern Kentucky and I am not convicted, would that affect my probation/pretrial diversion in Tennessee since they are two separate states and I am technically not guilty or convicted in Northern Kentucky?
